Agreement to terms

By accessing or using the Linkstonic website, applications, APIs, and related services (collectively, the “Service”), you agree to these Terms of Service (“Terms”). If you use the Service on behalf of an organization, you represent that you have authority to bind that organization, and “you” includes the organization.

If you do not agree, do not use the Service.

The Service

Linkstonic provides software and related services for AI visibility tracking, SEO audits, reporting, integrations (such as search console or notification tools), and similar features described on our site or in your order. We may modify, suspend, or discontinue parts of the Service with reasonable notice where practicable.

The Service may depend on third-party platforms (including AI providers and data sources). Output, availability, and accuracy can vary; see Disclaimers.

Accounts and access

You must provide accurate registration information and keep credentials confidential. You are responsible for activity under your account. Notify us promptly of unauthorized use.

We may refuse registration or suspend access for violations of these Terms, risk to the Service or others, or legal requirements.

Acceptable use

You agree not to:

• Use the Service in violation of law or third-party rights.
• Attempt to gain unauthorized access to systems, data, or accounts.
• Probe, scan, or test vulnerabilities without authorization, or interfere with the Service’s operation.
• Reverse engineer the Service except where applicable law permits despite this limitation.
• Use the Service to send spam, malware, or deceptive content, or to harass others.
• Resell or redistribute the Service in violation of your plan or our written agreement.
• Submit or process highly sensitive categories of personal data (as defined under applicable privacy law) unless we explicitly agree in writing and appropriate safeguards are in place.

You retain rights in your content; you grant us a license to host, process, and display your content only as needed to provide and improve the Service for you.

Third-party services

Integrations (for example Google, OpenAI, automation platforms) are subject to those providers’ terms and policies. We are not responsible for third-party services you choose to connect.

Plans, fees, and taxes

Paid plans, fees, and billing cycles are described at checkout or in an order form. Unless stated otherwise, fees are non-refundable except as required by law. You are responsible for applicable taxes. We may change prices with advance notice; changes apply to subsequent renewal periods.

Intellectual property

The Service, including software, branding, documentation, and our aggregate analytics (excluding your confidential content), is owned by Linkstonic and its licensors. Except for the limited right to use the Service under these Terms, no rights are granted.

Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT AI OR SEO INSIGHTS WILL BE ACCURATE OR COMPLETE. YOU USE INSIGHTS AT YOUR OWN RISK.

Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, NEITHER LINKSTONIC NOR ITS SUPPLIERS WILL BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR LOSS OF PROFITS, DATA, OR GOODWILL. OUR AGGREGATE LIABILITY FOR CLAIMS ARISING OUT OF OR RELATED TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US FOR THE SERVICE IN THE TWELVE MONTHS BEFORE THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS (IF YOU HAVE NOT PAID FEES). SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS; IN THOSE CASES OUR LIABILITY IS LIMITED TO THE MINIMUM ALLOWED BY LAW.

Indemnity

You will defend and indemnify Linkstonic and its affiliates, officers, and employees against third-party claims and costs arising from your content, your use of the Service in breach of these Terms, or your violation of law or third-party rights, subject to our prompt notice and reasonable cooperation.

Termination

You may stop using the Service at any time. We may suspend or terminate access for breach, risk, non-payment, or legal reasons. Provisions that by their nature should survive (including intellectual property, disclaimers, limitation of liability, indemnity, and governing law) will survive termination.

Governing law and disputes

These Terms are governed by the laws of India, without regard to conflict-of-law principles that would require application of another jurisdiction’s laws.

Subject to any rights you may have under mandatory local law (including consumer protection rules in your country), you agree that the courts located in New Delhi, India, will have exclusive jurisdiction over any dispute arising out of or relating to these Terms or the Service. Before filing a claim, you agree to contact us at support@linkstonic.com so we can try to resolve the matter informally.

Changes

We may update these Terms by posting a revised version on this page and updating the “Last updated” date. If changes are material, we will provide notice as required by law or as we reasonably deem appropriate. Continued use after the effective date constitutes acceptance of the updated Terms.
